Can A Casino Throw You Out?

When you plan a trip to a casino you
are planning on having some fun. It is likely that you may gamble, do some
drinking, eat, visit a nightclub, and even see a show. It is supposed to be a
fun experience. For most visitors to a casino what they get is the enjoyment
they wanted. However for a small percentage of people one thing can really ruin
the trip and it is being thrown out of a casino. I have thankfully never had
this happen to me but I assume it can be a terribly embarrassing event. As
someone is being dragged out by security, you may hear them yell “You can’t do
this to me, I’m a paying customer!” How true is that statement?
Well it depends. There are numerous
factors that must be considered before any advice could be given or even
researched. There are state laws that must be followed by casinos. No casino
may violate the Constitution. And various gaming commissions may have
regulations for casinos to follow. Most casinos are considered private property
but if they have a bar or nightclubs then that portion of the casino may
transform into a dram shop. Dram shops in tort law have special duties to
patrons. This distinction may be subtle but can be important when it comes to
determining liability.
Casinos may throw you out for a wide
range of reasons. Some of the most valid reasons for a casino to throw you out
would be for gambling while underage, being intoxicated and making a scene or
disturbing other people, and cheating. If you are thrown out of a casino for
one of those reasons there is likely a state law or regulation that allows for
casinos to take action to protect the welfare of other patrons.
